Terms of service

1.1. On the website gala.ee, KUJI OÜ (registry code 17205924, address: Lõõtsa tn 4, 11415 Tallinn, Harju County, account EE657700771011606887) provides a real-time online sushi ordering platform (hereinafter 'e-shop').

1.2. By using the e-shop, the customer confirms their agreement with the terms of use.

1.3. Only legally competent persons aged 18 or older may make purchases in the e-shop. The person whose bank account or card was used for payment is responsible for purchases made by persons not meeting the requirements.

1.4. By entering data in the e-shop, the person gives consent to the use of their personal data for purchasing products and using services.

1.5. The merchant (KUJI OÜ) has the right not to fulfill the customer's order if the customer has not complied with the e-shop's terms or has not paid for the order.

2.1. The customer is obligated to place orders, make payments and perform other operations in accordance with these terms of use and the instructions displayed in the e-shop. The customer is responsible for carefully verifying all data entered and bears the risk of any errors.

2.2. Before payment and final submission of the order, all data entered by the customer is displayed for review and correction of errors.

2.3. The merchant has the right not to fulfill the customer's instruction if the customer has not complied with the terms of use, e-shop instructions, or has not made payment.

2.4. Order confirmation and other necessary information is sent to the email address provided by the customer.

2.5. Upon receiving the order confirmation, the customer must immediately verify its accuracy and promptly inform the service provider of any inaccuracies.

2.6. When using the e-shop, the customer is obligated to:

• ensure the accuracy of all information submitted;
• not transmit illegal or otherwise prohibited information through the e-shop;
• not use the e-shop for fraudulent activities;
• not send files containing viruses or files that interfere with the operation of the e-shop;
• not modify, copy, transmit, sell, reproduce or otherwise misuse the e-shop or its content.

3.1. By paying for the order, the customer confirms that they have read and accept all terms of use.

3.2. The customer pays through the secure Montonio payment environment (bank transfers, cards, Apple Pay, etc.). After the transfer, the customer must click 'Return to merchant'. If this is not done or the connection is interrupted, the order will not be placed. In such cases, the customer may submit a refund request within 14 days to infosushi@gala.ee, specifying the account holder's name and payment date. KUJI OÜ has the right to process the request within 14 days and refund the money to the same account.

3.3. Payments are processed by Montonio Finance OÜ; funds are credited to KUJI OÜ account EE657700771011606887.

3.4. Prices in the e-shop are in euros and include all statutory taxes. No additional fees are charged by the service provider.

3.5. Product prices and availability may change without prior notice.

3.6. Product images in the e-shop are for illustration purposes and may differ from actual products.

4.1. Orders can be picked up at the point of sale where the order was placed. In this case, no delivery fee is charged.

4.2. If delivery is offered in the e-shop, a corresponding delivery fee applies. By ordering delivery, the customer confirms that they have reviewed the delivery conditions for their area.

4.3. The merchant may use partner services for delivery and is not responsible for the services provided by them.

4.4. The merchant is not responsible for delivery delays caused by inaccurate or incorrect data provided by the customer when placing the order.

5.1. The 14-day right of return does not apply to food products sold in the e-shop.

6.1. If the customer finds that a purchased product does not meet the merchant's established conditions, the merchant must be immediately informed. If no solution is found, a written complaint must be submitted as soon as possible, but no later than seven (7) days. The complaint must be sent to the merchant's postal or email address with supporting evidence. A complaint submitted after the deadline is considered expired.

6.2. The merchant responds to the customer's complaint within 14 days.

7.1. The merchant does not disclose the customer's personal data obtained during the use of the e-shop, except when disclosure is made with the customer's consent or the obligation or right to disclose arises from legislation or terms of use.

7.2. The customer understands and agrees that the use of the e-shop requires the transfer of personal data to third parties (bank / payment service provider).
